This agreement outlines your obligations as a member and explains our obligations to you. By registering with Hungry Elephant Limited you agree to the following terms and conditions:

1. Site Membership and Termination of Accounts

Hungry Elephant membership is available to not-for-profit organisations and charities based in the United Kingdom.

Hungry Elephant Limited only allows one account per organisation.

We reserve the right to refuse membership. Further, we reserve the right to terminate your Hungry Elephant account without notice at any time.

2. Commission Payments

As a Hungry Elephant member you will earn a percentage of the commission from our affiliate retailers as illustrated on the Hungry Elephant website whenever someone shops through the Hungry Elephant site having first entered your organisation’s unique ID.

We will make every effort to ensure commission levels are correctly illustrated.

It is important to note that all transactions made are not with us but the individual retailer.

Your Hungry Elephant account will only be credited when the retailer confirms the transaction. Sometimes this happens immediately, although often our retailers process transactions when their returns policy date has expired (this can be 30 days plus).

Should the goods be refunded or the sale otherwise reversed then the commission payment may not be made.

Commission can only be paid when someone shops through the Hungry Elephant site having first entered your organisation’s unique ID.

All transactions are electronically logged and reported back by the retailer. Hungry Elephant Limited will make every effort to ensure that retailers are correctly reporting sales. However, the reporting systems rely on the configuration of both the retailer’s computer and the customer’s computer and we cannot be held responsible should the retailers’ systems fail to report back a sale.

3. Payment Schedule

Commission payments will be issued monthly, 30 days in arrears providing your account balance exceeds £25. Accounts under this amount will be carried forward to the next month.

All payments will be made in pounds sterling.

Should a retailer delay payment or cease trading then we will make every effort to recover your commission. However Hungry Elephant Limited makes no guarantees to payment until funds have been received from the retailer or their agents.

4. Dormant Accounts

In the event that your Hungry Elephant account is dormant (showing no transactions) for a period exceeding 12 months then we reserve the right to terminate your account.

5. Modification of Agreement

We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion by posting a revised agreement on the Hungry Elephant website.

6. Miscellaneous

This Agreement will be governed by the laws of the United Kingdom, without reference to rules governing choice of laws.

Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
